Introduction to the User Agreement:
Our online store welcomes you (registered under number "1010733521"), and informs you that you will find below the terms and conditions regulating your use of this store and all legal effects resulting from your use of the store's services over the Internet via this electronic platform, as the use of any person for (Clean Express) whether a consumer of the store's service or product or otherwise, this is an approval and acceptance from him and he is fully qualified according to Sharia, system and law for all the articles and provisions of this agreement and it is a confirmation of your commitment to its regulations and what is mentioned therein, and this agreement applies to all types of dealings between the user and the store except for dealings related to personal status and dealings related to issuing deeds related to the actions contained in the property. This agreement is considered valid and effective once you approve it and start registering with (Clean Express) in accordance with Article 10 of the Saudi Electronic Transactions System.
Article One - Introduction and Definitions:
The above introduction is an integral part of this Agreement. Below you will find the meanings and definitions of the main terms used in this Agreement:
1. (Clean Express) This term means (Clean Express), and this definition includes all forms of (Clean Express) on the Internet, whether it is an electronic application, a website on the Internet, or a commercial store.
2. (User) This term refers to every consumer who purchases the product or service from the store through its electronic platform.
3. (Agreement) This term means the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.
Article Two - User's Legal Capacity:
1. The user acknowledges that he has the legal capacity recognized by Sharia and the system to deal with the store, or that he is not less than eighteen years old.
2. The user agrees that if he violates this article, he will bear the consequences of this violation before third parties.
Article Three - Nature of Clean Express’s commitment:
1. Clean Express’ commitment to consumers or users is to provide the (service or product).
2. Clean Express may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the user.
Article Four - Controls for using (Clean Express):
1. The user is committed to using the electronic platform of (Clean Express) in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2. When purchasing a service or product (Clean Express), the user undertakes not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.
Article Five - Accounts and Registration Obligations:
Upon applying to join the membership of (Clean Express) as a user, you are obligated to disclose specific information and choose a user name and a secret password to be used when accessing the services of (Clean Express). Thus, you have agreed to:
1. You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify Clean Express immediately of any unauthorized use of your account information with Clean Express or any other breach of your confidential information.
2. Clean Express will not be responsible in any way for any loss that may be incurred by you directly or indirectly, morally or materially, as a result of disclosing your username or password information.
3. You are committed to using your account or membership with (Clean Express) yourself, as you are fully responsible for it, and if someone else uses it, this is evidence that you have authorized him to use the store in your name and on your behalf.
4. You agree that when using (Clean Express) you will use it with all seriousness and honesty.
5. You undertake to disclose true, correct, current, complete and legal information about yourself as required during registration with (Clean Express) and you undertake to update your data in the event of a change in reality or if necessary.
6. Clean Express is committed to treating your personal information and contact addresses with complete confidentiality.
7. If Clean Express finds that you have disclosed information that is false, incorrect, outdated, incomplete, illegal, or in violation of the User Agreement, Clean Express has the right to suspend, freeze, or cancel your membership, store, or account on the platform, without prejudice to Clean Express’ other rights and legitimate means of recovering its rights and protecting other users.
8. In the event of non-compliance with any of the above, the management of (Clean Express) has the right to suspend or cancel your store or membership or block you from accessing (Clean Express) services again.
Article Six - Electronic Communications and Official Means of Communication:
1. The parties to this agreement agree that communication will be via email, phone or WhatsApp to the number registered on the platform.
2. The User agrees that all agreements, notices, statements and other communications provided to him electronically are equivalent to their written counterparts, and are self-contained evidence, in meeting regulatory and legal requirements.
3. The user agrees to the possibility of communicating with him and informing him of any provisions related to this agreement or related to dealing with him by the management of (Clean Express) broadcasting general messages to all users or to specific users of (Clean Express).
Article Seven - Amendments to the User Agreement and Fees:
1. Clean Express may notify you of any amendment to this Agreement in accordance with the official means of communication under this Agreement, and accordingly your obligations will be doubled or your rights will be diminished in accordance with any amendments that may be made to this Agreement.
2. In the event of an objection to any amendment to the User Agreement, Clean Express hopes that you will stop using its services, as your mere access to your account in Clean Express or your use of Clean Express constitutes your acceptance of the amendments and full and complete consent, negating ignorance, and Clean Express accepts discussion of any proposal regarding these provisions.
3. All fees are calculated in Saudi Riyals, and the user must pay all fees due on the platform, in addition to any other expenses added by (Clean Express), provided that payment is made through the approved, specified and available means through (Clean Express).
4. Clean Express may impose fees on some users, depending on the offers or coupons given to the customer, the services they request, or the fees or taxes imposed by the state on the nature of the product or service. Each according to the coupons imposes 25 percent of the invoice value (residential coupon).
5. Clean Express reserves the right to add, increase, reduce or deduct any fees or expenses under the articles, terms and provisions of the User Agreement, for any user, regardless of the reason for their registration.
Article Eight - Payment and settlement services for stores in (Clean Express):
1. Clean Express provides, through its partners, the payment and settlement system in Clean Express. It can be done entirely online through the payment options available on Clean Express or through any payment method provided by Clean Express from time to time.
2. Clean Express is committed to setting the price of the service or product it offers in its store according to the recognized market value.
3. (Clean Express) is committed to providing invoices, receipts and receipts for all amounts and profits generated in its store, and is committed to giving the user an invoice for his purchase of a service or product (Clean Express).
4. (Clean Express) is committed to providing the generally accepted accounting specifications in its online store, in application of the provisions of this agreement, and for the legal, economic, commercial and organizational interests in this organization.
Article Nine - Your Personal Information and Transaction Details Information:
1. The user acknowledges that he grants (Clean Express) an unlimited, global, permanent, irrevocable, free of charge, and licensed right to use personal or other information or materials provided or supplied by (Clean Express) or announced on the platform by joining or using it, through the forms designated for communication and registration, or via any electronic message or any of the communication channels available on the platform. This is for the purpose of achieving any of the interests that the platform deems appropriate.
2. The provisions of confidentiality of consumer information are subject to the rules of the “Privacy and Confidentiality Policy” of (Clean Express), and to the provisions contained in this agreement related to confidentiality of information.
Article 10 - Intellectual Property:
1. The intellectual property rights of (Clean Express) are rights owned by (Clean Express) in full, whether they were owned by them before or after the establishment of this electronic platform.
2. The user or consumer respects the intellectual property rights of (Clean Express), which include (Clean Express) itself, the words, logos, interfaces, shapes and the arrangement thereof, whether the application or the web, the user interface and other symbols of (Clean Express) or displayed on (Clean Express), as (Clean Express), and every right that follows (Clean Express), are rights owned entirely by (Clean Express) intellectual property.
Article Eleven - Responsibility of (Clean Express):
1. (Clean Express) is committed to conducting its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.
2. (Clean Express) shall not bear any claims arising from errors or negligence, whether directly or indirectly or incidentally caused by the workers or by the user or by a third party such as a company contracted to provide the service or any damages to any service items, including but not limited to plumbing, painting, doors, sanitary ware and floors. The responsibility shall return to the contractor of the item due to poor implementation or otherwise.
3. (Clean Express), its employees, owners and representatives are committed to ensuring that the (product or service) is sound, legitimate and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.
Article Twelve - Confidentiality of Information:
1. Clean Express takes (tangible, organizational and technical) standards to protect users and prevent unauthorized access to and storage of users’ personal information.
2. You, as a user, acknowledge that the Internet is not a completely secure medium, and the confidentiality of your personal information cannot be 100% guaranteed through (Clean Express).
3. (Clean Express) has no control over the actions of any third party, or others, such as other web pages linked through links to the platform or third parties claiming to represent you and others.
4. You acknowledge and agree that (Clean Express) may use your information that you have provided to it, for the purpose of providing services to you in (Clean Express), and to send marketing messages to you, and that the privacy in (Clean Express) regulates the collection, processing, use and transfer of your personal identity information, and the rules of information confidentiality are subject to the “Privacy and Information Confidentiality Policy” of (Clean Express).
Article Thirteen - Restriction of Access or Membership:
Clean Express may suspend or cancel a User’s membership or restrict a User’s access to the Platform Services at any time, without notice, for any reason, and without limitation.
Article Fourteen - Replacement Policy:
1. Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to request that comments be processed after the service provided to him by (Clean Express) within the same day of the service date, and he does not have the right to return the service after the day has passed.
2. In order to return the service, the service must not have been used and the consumer must not have used the service or obtained its benefit. Clean Express has the right to inspect the service before returning it to ensure that 8 hours have passed since the request.
3. The consumer is not entitled to replace or return the service in the following cases:
If the service has been utilized and the site has been delivered to the consumer or his representative.
If a defect appears in the service provided after delivery due to poor performance by the consumer.
If the request is a cleaning service.
Article Fifteen - Return Policy:
1. Without prejudice to the provisions of the contractual and regulatory warranty, the consumer has the right to cancel the order and return the service provided to him by (Clean Express) within the first hour before work, and he shall bear the arrival cost of 34 riyals and the remainder shall be returned to him, and he is not entitled to this service after the same day has passed after delivery.
2. In order to retrieve the service, the work must not have started and the consumer must not have benefited from the service for an hour or a number of hours or obtained its benefit. Clean Express has the right to inspect the service, its details and hours before retrieving it to ensure that work hours have not started.
3. The consumer is not entitled to return the service in the following cases:
If the team arrived at the site and no calls were answered.
If the order is left for 8 hours or less, it cannot be cancelled or returned.
If the team contacts him and does not respond after 30 minutes of waiting, the request is considered to have been executed.
If a defect appears in the service due to the use of the area in which the consumer cleaning service is applied.
4. If the provisions of the aforementioned return policy are met, the consumer has the right to cancel the contract and return the order to (Clean Express) with a refund of the amount paid.
Article Sixteen - Applicable law or regulation:
This User Agreement is governed by and formulated in accordance with the laws, regulations and legislation in force and in effect in the Kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.
Article Seventeen - General Provisions:
In the event that any provision or clause contained in this User Agreement is cancelled or that any provision or clause contained in this User Agreement is no longer valid, such matter does not cancel the validity of the remaining provisions, clauses and terms contained in the User Agreement and they remain valid until further notice from the management of (Clean Express).
This User Agreement - which may be amended from time to time as appropriate - constitutes the User Agreement, working mechanism, understanding, agreement and contract between (Clean Express) and the user. Both parties to this agreement agree to take into consideration the following:
1. The Arabic language is the language used when interpreting the provisions of this Agreement, or when translating it into another language.
2. All prices displayed for Clean Express services or products may be modified from time to time.
2.1 Regarding coupons, each customer is entitled to one coupon for a discount. Two discounts may not be combined together only when distributing them. When the customer reaches more than one coupon, the use is considered for only one coupon and the remaining coupons are confirmed. He is not entitled to benefit from the quantity of other coupons, whether his family members or his friends, only one service location and one home.
3. The promotional or marketing offers, whether discount codes or coupons, that Clean Express may place are temporary offers, as Clean Express has the right to modify or stop these promotional or marketing offers at any time.
4. The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules, regulations and laws in force related to the nature of the dealings between (Clean Express) and the user.
5. This User Agreement shall not be cancelled except by a decision issued by the management of (Clean Express).
